TRUSTEE’S SALE OF VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated June 24, 2014, and duly recorded in the Office of the Clerk of the County Commission of Summers County, West Virginia, in Deed of Trust Book 272, at Page 639, Thomas J. Mathewson did convey unto Larrick Law Offices, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Summers County Courthouse, in Hinton, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Green Sulphur District, Summers County, West Virginia, and more particularly described as follows:

BEGINNING on a forked sycamore on the south side of Duncan Branch opposite a small fork; thence N. 48 40 E. 110.91 feet running with the fence to the southerly R/W of W.V. Secondary Route No. 44/3 just below a small bridge; thence running with the fence and said R/W N. 65 51 E. 132.31 feet to a fence post; thence N. 77 45 E. 30.02 feet to a fence post; thence N. 89 06 E. 19.21 feet to a fence post; thence S. 80 33 E. 39.09 feet to the westerly gate post; thence S. 61 15 E. 131.14 feet to a fence post; thence across the bottom S. 26 22 W. 199.19 feet to a 16” sycamore on the north side of Duncan Branch; thence down the branch but not with its meanders, N. 70 50 W. 346.76 feet to the beginning, containing approximately 1.3 acres, according to survey of Hamilton Sharpe, LLS, said map dated October 16, 1975, a copy of which is of record in the Office of the Clerk of the County Court of Summers County.

And being the same property acquired by Thomas J. Mathewson and Kumcha Mathewson by deed dated May 10, 1995, from Guy Harris and Linda S. Harris, his wife, to be recorded in the Office of the Clerk of the County Commission of Summers County, West Virginia, prior to or simultaneously herewith.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 346 Duncan Branch Road, Meadow Bridge, WV 25976.

AND BEING the same real estate which was conveyed to Thomas J. Mathewson, by Deed dated June 24, 2014, from Randall L. Harris and Kathy Y. Harris, and recorded in the Office of the Clerk of the County Commission of Summers County, West Virginia, in Deed Book 249 at Page 361.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
