NOTICE OF SALE BY SPECIAL COMMISSIONER

Notice is hereby given that by virtue of that certain Order entered on September 12, 2024, in the Circuit Court of Summers County, West Virginia, Civil Action No.: CC-45-2024-C-20, Christopher Carrion, et al, v. Ashley Carrion, that the Court found that the subject property in said action will be sold at partition sale by Anna R. Ziegler, Special Commissioner. The subject property consists of 25 acres, to be the same, more or less, and being the same property conveyed unto Arnold Simon Bennett and Debra A. Bennett, his wife, as joint tenants with rights of survivorship, by deed dated September 22, 2000, and of record in the Office of the Clerk of the County Commission of Summers County, West Virginia, in Deed Book 202 at Page 567. The said Arnold Simon Bennett having died, vesting title unto Debra A. Bennett. The said Debra A. Bennett having died on or about March 3, 2024, intestate, leaving as heirs the Petitioners and Respondent herein.

Notice is hereby given that the following described property will be sold at a partition sale, which said sale shall occur on the front steps of the Summers County Courthouse, West Virginia, on December 13, 2024, at 10:00 a.m.

All that tract of land situate in Greenbrier District of Summers County, West Virginia and being more particularly described as follows:

BEGINNING at a water elm on the line of the land formerly owned by the Lilly heirs; thence with the line of Chattin passing a sycamore on the bank of Big Cave Branch to a hickory; thence continuing with Chattin to a locust on the line of Bennett and with the line of Bennett and passing a rock with an “X” mark on the bank of Big Cave Branch, to pine on the line of the land formerly owned by the Lilly heirs; thence with the Lilly heirs line to the water elm, the place of BEGINNING, and containing 25 acres, more or less.

AND BEING the same property conveyed unto Arnold Simon Bennett and Debra A. Bennett, his wife, by deed dated September 22, 2000, and of record in the Office of the Clerk of the County Commission of Summers County, West Virginia, in Deed Book 202 at Page 567.

Said real estate will be sold as a whole tract of 25 acres more or less, as is, where is, without any warranty express or implied as to the condition of the premises. Any deed to be delivered to a buyer at this sale will be by special warranty deed.

The Special Commissioners reserve the right to reject any bid deemed inadequate.

Terms of sale: Ten percent cash in hand on day of sale, to be held in escrow pending approval by the Circuit Court of Summers County, West Virginia. Balance due upon confirmation of sale by the Court.
