The object of the above-entitled action is to partition the hereinafter described real estate by sale set forth in the Petitioner’s “Petition For Partition By Sale”. In addition, Petitioner asserts that they are unable to locate the Respondent after due diligence and Petitioners are requesting that under W. Va. R. Civ. Pro. 4(e)(1)(C) this Court order publication so that proper notice of said “Petition For Partition By Sale” may be served upon the Respondent.
After the review of the Affidavit filed by Petitioners’ Attorney in this action, this Court agrees that the Petitioners and Petitioners’ Attorney used due diligence in locating the Respondent, and was unable to do so. As such, it is ORDERED that publication be made regarding this matter. It is further ORDERED that Respondent appear and serve upon Anna R. Ziegler, counsel for plaintiff, whose address is 110 James Street, Hinton, West Virginia 25951, an answer or other defense to the Complaint filed in this action on or before September 2, 2024.
A copy of said Petition and Motions can be obtained from the undersigned Clerk at her office in Hinton, Summers County, West Virginia.
