JUMPING BRANCH W.Va. (Hinton News) – According to a criminal complaint, on Dec. 11, an officer received a call regarding a person taking a vehicle without permission in the vicinity of Will Dodd Road.
The officer then made contact with the accused, later identified as Harold Price, in a red Nissan Sentra, which reportedly matched the vehicle described by the victim. Price was asked to step out of the vehicle, and the officer could allegedly smell an intoxicating substance coming from Price.
The officer then explained and administered the Horizontal Gaze Nystagmus test, in which Price showed signs of impairment, according to the criminal complaint. The officer then explained, demonstrated, and administered the walk and turn. Price once again reportedly showed signs of impairment. The officer next explained, demonstrated, and administered the one-leg stand test. Price again allegedly showed signs of impairment. Price provided a breath sample using an Alco sensor FST. The sample was a .228.
Price was then transported to the WVSP Hinton Detachment for processing and read the WVSP 47a implied consent form and signed it at 6:07 p.m. Price then provided a sample of intox EC/IR 11 with a reported .236 result. Price was charged with aggravated DUI, unlawful taking of a vehicle, and driving revoked.
At the time of publishing, Price is in Southern Regional Jail with bail set at $6,000.
