Order Approving Motion for Publication

The object of the above-entitled action is to quiet title to property owned by Petitioner Patricia Meador as set forth in the Petitioner’s “Suit to Quiet Title”. In addition, Petitioner asserts that she is unable to locate the Respondent after due diligence and Petitioner moves for an Order of Publication pursuant to W. Va. R. Civ. Pro. 4(e)(1)(C) so that proper notice of said “Suit to Quiet Title” may be served upon the Respondent or other interested persons.

After the review of the Affidavit for Publication, this Court agrees that the Petitioner and Petitioner’s Attorney used due diligence in locating the Respondent but was unable to locate it and that there may be other interested persons. As such, it is ORDERED that publication be made. It is further ORDERED that Respondent appear and serve upon Anna R. Ziegler, counsel for plaintiff, whose address is 110 James Street, Hinton, West Virginia 25951, an answer or other defense to the Complaint filed in this action within thirty (30) days of the first date of publication otherwise judgment by default will be taken against them.

A copy of said Petition and Motions can be obtained from the undersigned Clerk at her office in Hinton, Summers County, West Virginia.
